Parent/Guardian Consent and Waiver of Liability

I, the undersigned, am the parent or legal guardian of the child named below (the "Participant"). I hereby give my full consent and permission for my child to participate in the Bnei Aliya Yeshiva 

Verification of Legal Guardianship:

I hereby certify that I am the legal parent or guardian of the Participant and have the authority to make decisions on behalf of the Participant regarding their involvement in the Yeshiva.

Waiver of Liability:

In consideration of the Participant being permitted to participate in the Yeshiva, I, on behalf of myself and the Participant, hereby release, waive, discharge, and covenant not to sue the Aliya Institute, its directors, officers, employees, volunteers, and agents (collectively, the "Releasees") from and against any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or harm to the Participant, including death, that may be sustained by the Participant, whether caused by the negligence of the Releasees or otherwise while participating in or traveling to or from the Camp.

Indemnification:

I agree to indemnify, defend, and hold harmless the Releasees from and against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including reasonable attorneys’ fees, that are incurred by the Releasees arising out of or related to any third-party claim, suit, action, or proceeding arising out of the Participant’s involvement in the Camp.

Medical Authorization:

In the event of an emergency, I authorize the Yeshiva staff to obtain medical treatment for the Participant if I cannot be reached. I understand that I will be responsible for any medical expenses incurred. Furthermore, I authorize Rabbi Moshe Feiglin to make necessary medical decisions on behalf of the Participant if I am not readily available.

Assumption of Risk:

I understand that participation in the Yeshiva involves certain risks and hazards which may result in injury, death, or other loss. I knowingly and voluntarily assume all such risks, both known and unknown, even if arising from the negligence of the Releasees or others, and assume full responsibility for the Participant’s participation in the Yeshiva.

Authorization for Out-of-State Trips:

I give permission for the Participant to participate in overnight trips and out-of-state travel as part of the Yeshiva’s activities. I understand that these trips may involve additional risks, and I consent to the Participant’s involvement in such trips.

Right to Terminate Participation:

I understand and agree that the Aliya Institute and Rabbi Moshe Feiglin reserve the right to terminate the Participant’s involvement in the Yeshiva at any time if it is reasonably determined, in their sole discretion, that the Participant poses a danger to themselves or others. In such an event, I agree to cooperate immediately with the termination and arrange for the Participant’s prompt departure from the Yeshiva.

Arbitration Clause:

The parties agree that any and all disputes that may arise, Chass Ve'Shalom, from this agreement, or otherwise between the undersigned, shall be under the exclusive jurisdiction of the Beis Din Of Crown Heights, located at 392 Kingston Avenue, Brooklyn, NY 11213 (Beis Din), or its assignees, for legally binding arbitration. And, the parties agree to waive any and all objections to the jurisdiction of the Beis Din and granting to the Beis Din/Arbitrator, the power to issue a binding decision on default against a party who fails to respond to notice to appear before The Beis Din.
